Welcome to Kintsura. These Terms and Conditions (“Terms”) govern your access to and use of [Website URL], the Kintsura membership portal, coaching and meditation offerings, live sessions, communities, worksheets, interactive tools, downloadable materials, and other services or content provided by Elizabeth Lauren Bucher, doing business as Kintsura, an Oregon sole proprietor (“Kintsura,” “we,” “us,” or “our”).

By accessing the website, creating an account, purchasing a membership, registering for a program, or using any of our services or materials, you agree to these Terms. If you do not agree, please do not use the website, portal, or services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the membership portal, purchase services, or participate in Kintsura programs.

By using these services, you represent that you meet these requirements.

2. Nature of the Services

Kintsura provides mental health coaching, mindfulness and meditation instruction, educational resources, reflective tools, community spaces, and related personal-development services.

These offerings are intended to support self-reflection, personal growth, emotional awareness, habit development, stress management, and general well-being.

Coaching is not therapy or medical care

Kintsura does not provide psychotherapy, psychiatric treatment, medical treatment, diagnosis, crisis intervention, or other licensed healthcare services.

Although coaching may include discussion of emotions, thoughts, relationships, behavior patterns, and mental health-related experiences, it is not a substitute for care from a licensed mental health professional or medical provider.

Your use of the website, portal, resources, or community does not create a therapist-client, physician-patient, or other healthcare-provider relationship.

If you are currently receiving treatment, you are responsible for deciding—with the assistance of your qualified healthcare providers, when appropriate—whether coaching, meditation, or any particular resource is suitable for you.

Do not disregard or delay seeking professional advice because of information provided through Kintsura.

3. Emergencies and Crisis Support

Kintsura does not provide emergency or crisis services. The website, portal, community, direct messages, email, and coaching communications are not continuously monitored.

If you believe you or another person may be in immediate danger, call 911 or your local emergency number.

If you are in the United States and experiencing a mental health, suicide, or substance-use crisis, call or text 988 to reach the Suicide & Crisis Lifeline. If you are outside the United States, contact the emergency or crisis service available in your location.

Do not rely on Kintsura, its community, or its communication channels for urgent assistance.

4. Personal Responsibility and Results

You are responsible for your own decisions, actions, well-being, and use of the information and practices offered through Kintsura.

Coaching, mindfulness, meditation, worksheets, and other reflective practices affect people differently. No particular outcome, improvement, transformation, or result is promised or guaranteed.

Some practices may bring up uncomfortable emotions, memories, physical sensations, or other difficult experiences. You may pause or discontinue an exercise at any time. Seek qualified professional support if you experience significant or persistent distress.

You agree to use reasonable judgment and participate only to the extent that feels appropriate and safe for you.

5. Membership Accounts

Some services require you to create a private account. You agree to:

  • Provide accurate and current information;
  • Keep your login credentials confidential;
  • Use only your own account;
  • Notify us promptly if you believe your account has been accessed without permission; and
  • Accept responsibility for activity occurring through your account to the extent permitted by law.

Memberships are issued to individuals and may not be shared, transferred, resold, or made available to another person.

We may suspend access when we reasonably believe an account has been compromised or is being shared improperly.

6. Membership Plans and Automatic Renewal

Kintsura may offer monthly and annual membership plans. The price, billing interval, included features, and any applicable trial or promotional terms will be displayed before purchase.

Unless otherwise stated at checkout:

  • A monthly membership automatically renews each month;
  • An annual membership automatically renews each year; and
  • The payment method on file will be charged at the beginning of each new billing period until the membership is canceled.

By purchasing a recurring membership, you affirmatively authorize Kintsura and its payment processor to charge the disclosed recurring amount, along with any applicable taxes, using your selected payment method.

Renewal terms will be presented before purchase and included in a confirmation that you can retain.

If we make a material change to the price or renewal terms, we will provide advance notice as required by applicable law. Your continued membership after the change takes effect constitutes acceptance of the new terms to the extent permitted by law.

7. Cancellation

You may cancel your membership at any time using the cancellation option provided in your account or by contacting us at liz@mylifeinbalance.co

Unless otherwise required by law:

  • Cancellation stops future renewals;
  • You will continue to have access through the end of your current paid billing period;
  • Cancellation does not retroactively refund previous charges; and
  • Deleting your account or discontinuing your use of the portal does not automatically cancel an active paid subscription.

You are responsible for canceling before your next renewal date if you do not want to be charged for another billing period.

8. Refunds

Because memberships provide immediate access to digital content, community features, and other benefits, payments are generally nonrefundable once processed.

However, we understand that unusual circumstances occur. Refund requests may be considered individually at our discretion. To request consideration, contact [Support Email Address] and include the email address associated with your account, the date of the charge, and a brief explanation.

Nothing in this section limits any refund, cancellation, or other consumer right that cannot legally be waived.

9. Changes to Membership Features

Membership offerings may evolve. We may add, modify, replace, reschedule, or discontinue particular resources, tools, community features, live sessions, or other membership benefits.

We will not represent a membership as including a specific core feature and then remove that feature without reasonable notice. If a material change substantially reduces the overall nature of a prepaid membership, we may offer an appropriate accommodation or refund where required by law or reasonably warranted under the circumstances.

Temporary interruptions caused by maintenance, technical problems, illness, emergencies, third-party platforms, or circumstances beyond our reasonable control do not automatically entitle members to a refund.

10. Live Coaching and Meditation Sessions

Membership may include access to live coaching, discussion, mindfulness, or meditation sessions.

Scheduled sessions, facilitators, formats, topics, and availability may change. Unless expressly promised as part of a particular plan, attendance at a specific session or with a specific facilitator is not guaranteed.

Live group sessions are educational and supportive spaces, not group psychotherapy. Participation does not establish a confidential therapist-client relationship.

You may choose how much you wish to share. Nevertheless, you should avoid disclosing information you would not want other participants to know.

Members must not record, photograph, transcribe, livestream, distribute, or reproduce a live session without prior written permission from Kintsura and the informed permission of all affected participants.

11. Community Spaces and Member Conduct

Kintsura may provide access to a private Discord server, discussion area, group chat, or other community space.

These communities are intended to support respectful reflection, learning, and connection. By participating, you agree not to:

  • Harass, intimidate, threaten, shame, stalk, or discriminate against another person;
  • Post hateful, abusive, sexually exploitative, or deliberately inflammatory material;
  • Encourage self-harm, violence, illegal conduct, or dangerous behavior;
  • Present yourself as another person or falsely claim professional qualifications;
  • Diagnose, prescribe treatment to, or attempt to provide crisis care for another member;
  • Solicit clients, promote unrelated products, recruit members, or send unwanted private messages;
  • Share another person’s private information or community posts without permission;
  • Upload malicious code or interfere with the operation or security of the community;
  • Infringe intellectual-property or privacy rights; or
  • Use community content to train artificial-intelligence systems, compile datasets, conduct research, or create commercial materials without written permission.

We may moderate content and remove posts, but we are not obligated to review every communication. The views expressed by members belong to those members and do not necessarily represent Kintsura.

We may warn, restrict, suspend, or remove a member who violates these standards or whose conduct reasonably threatens the safety, privacy, or functioning of the community.

12. Limits of Community Confidentiality

We ask members to respect one another’s privacy, but Kintsura cannot guarantee that another participant will keep information confidential.

Community posts, live discussions, direct messages between members, and other peer interactions are not protected by therapist-client privilege, medical privacy laws, or any professional duty of confidentiality merely because they occur within a Kintsura space.

Please share thoughtfully. Do not post sensitive information about another person without that person’s permission.

Kintsura may preserve, review, or disclose information when reasonably necessary to operate the service, enforce these Terms, respond to suspected abuse, protect someone from a credible threat, comply with law, or respond to valid legal process.

Our collection and handling of personal information are described more fully in our Privacy Policy.

13. Interactive Worksheets and Personal Entries

The portal may contain interactive worksheets, journaling prompts, assessments, trackers, or other tools that allow you to enter personal information.

These tools are provided for education and self-reflection. They are not diagnostic instruments and do not generate medical or psychological advice.

You are responsible for deciding what information to enter and for maintaining copies of anything you wish to preserve. Unless expressly stated otherwise, we do not guarantee permanent storage, recovery, or continued availability of worksheet entries.

Do not use the portal as the only place you store information that is essential, irreplaceable, or needed for medical care.

14. Downloadable and Educational Materials

Membership resources may include PDFs, worksheets, recordings, meditations, written exercises, illustrations, templates, and other downloadable or viewable materials.

Unless otherwise stated, these materials are licensed to you for your own personal, noncommercial use while you are an authorized purchaser or member.

You may download or print materials for your own use where the portal allows it. You may not:

  • Sell, sublicense, publish, reproduce, or redistribute the materials;
  • Share materials with clients, groups, classes, communities, or other third parties;
  • Upload materials to another website, platform, shared drive, course, or membership;
  • Remove copyright, trademark, attribution, or ownership notices;
  • Modify the materials and present them as your own;
  • Use the materials to create a competing product or service; or
  • Use the materials to train or evaluate an artificial-intelligence model.

15. Intellectual Property

The website, membership portal, brand identity, graphics, designs, text, videos, recordings, meditations, exercises, worksheets, interactive tools, curriculum, and other original materials are owned by Kintsura or used with permission and are protected by applicable intellectual-property laws.

“Kintsura,” associated logos, and related branding may not be used without prior written permission.

Except for the limited personal-use license expressly granted in these Terms, no ownership or other intellectual-property rights are transferred to you.

16. Content You Submit

You retain ownership of original content you submit through community spaces, comments, or other interactive features.

By posting content in a community area, you grant Kintsura a limited, nonexclusive license to host, display, reproduce, and process that content only as reasonably necessary to operate, moderate, secure, and improve the applicable service.

This license does not give Kintsura permission to sell your personal reflections or use identifiable personal stories in marketing without separate permission.

You represent that you have the right to submit your content and that doing so does not violate another person’s rights.

17. Testimonials and Shared Experiences

We will not publicly use your name, image, testimonial, private coaching information, or identifiable personal story for marketing without your permission.

If you voluntarily submit a testimonial for promotional use, any specific permission, attribution choice, or withdrawal terms associated with that testimonial will be addressed separately.

Individual experiences are not guarantees that another person will obtain the same result.

18. Third-Party Services and Links

Kintsura may rely on third-party services such as payment processors, video-conferencing platforms, Discord, email providers, hosting services, or embedded applications.

Your use of a third-party service may also be governed by that provider’s own terms and privacy practices. Kintsura does not control and is not responsible for a third party’s independent conduct, availability, security, content, or policies.

Links to external websites are provided for convenience or education and do not necessarily constitute endorsement.

19. Prohibited Use

You may not use the website, portal, or services:

  • For an unlawful, fraudulent, harmful, or deceptive purpose;
  • To interfere with security or platform operation;
  • To gain unauthorized access to accounts, systems, or data;
  • To scrape, harvest, copy, or systematically extract content or member information;
  • To impersonate Kintsura, its owner, another member, or another person;
  • To violate another person’s privacy, safety, or intellectual-property rights; or
  • In any manner that materially disrupts services or the experience of other members.

20. Suspension and Termination

You may stop using the services at any time, subject to the cancellation provisions above.

We may suspend or terminate access if you materially violate these Terms, misuse the services, fail to pay amounts due, infringe intellectual-property rights, threaten another person’s safety, seriously disrupt the community, or create unreasonable legal or security risk.

When reasonably appropriate, we may first provide notice and an opportunity to correct the issue. Immediate action may be taken when necessary to protect people, content, systems, or the integrity of the community.

If we terminate a paid membership without cause, we may provide a prorated refund for the unused portion of the current billing period. If access is terminated because of a material violation of these Terms, a refund is not guaranteed.

Sections that reasonably should survive termination—including provisions concerning intellectual property, disclaimers, liability, disputes, and amounts already owed—will continue to apply.

21. Availability and Disclaimer of Warranties

We work to provide useful and reliable services, but the website, portal, content, and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We do not guarantee that:

  • The services will always be available, uninterrupted, secure, or error-free;
  • Every resource will be appropriate for every person;
  • Content will address your particular circumstances;
  • Stored information will never be lost; or
  • Participation will produce a particular personal, professional, emotional, or health-related outcome.

Nothing in these Terms excludes a warranty or consumer protection that cannot lawfully be excluded.

22. Limitation of Liability

To the fullest extent permitted by law, Kintsura and [Your Full Legal Name] will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of—or inability to use—the website, portal, community, content, or services.

To the fullest extent permitted by law, Kintsura’s total liability for a claim relating to a paid membership will not exceed the amount you paid to Kintsura for that membership during the six months immediately preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including where applicable to intentional misconduct, gross negligence, or rights that cannot be waived under consumer-protection law.

23. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Kintsura and [Your Full Legal Name] from third-party claims, losses, or reasonable expenses arising from your unlawful conduct, your material violation of these Terms, content you submit, or your infringement of another person’s rights.

This provision does not require you to indemnify Kintsura for its own negligence, unlawful conduct, or breach of these Terms.

24. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Before filing a legal claim, you and Kintsura agree to make a good-faith effort to resolve the dispute informally. You may begin that process by contacting liz@mylifeinbalance.co with a description of the concern and the resolution you are requesting.

If the dispute cannot be resolved informally, any legal proceeding will be brought in a state or federal court with jurisdiction in Umatilla, Oregon, unless applicable consumer law gives you the right to bring the proceeding elsewhere.

Nothing in these Terms prevents either party from seeking appropriate relief in small-claims court or requesting urgent injunctive relief where legally available.

25. Changes to These Terms

We may update these Terms to reflect changes in services, business practices, technology, or legal requirements.

The updated version will be posted with a revised “Last updated” date. If a change materially affects an active paid membership, we will provide reasonable notice before the change takes effect when required by law.

Your continued use of the services after updated Terms take effect constitutes acceptance of those Terms. If you do not agree to a material change, you may cancel your membership before the change becomes effective.

26. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted or limited as closely as legally permitted to its intended purpose.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

27. Entire Agreement

These Terms, together with the Privacy Policy, any checkout disclosures, and any separate agreement that applies to a specific coaching service or program, constitute the agreement governing your use of the website and membership services.

If a separate signed coaching agreement conflicts with these Terms regarding an individual coaching relationship, the signed coaching agreement will control for that relationship.
